In order to register a vehicle in the electronic toll system, the user is obliged - in accordance with the Act and the Decree - to provide the system operator with the data necessary to register the vehicle and submit the vehicle technical certificate or the vehicle registration certificate. In particular, the vehicle operator shall provide the following information:
- the vehicle license plate number and the country where the vehicle is registered;
- the vehicle category pursuant to the applicable legislation;
- total vehicle weight, number of axles and vehicle emission class;
- indication of whether the vehicle is equipped with equipment or modification that could impede the proper functioning of the electronic device (on-board unit), for example, whether the vehicle has a metallised windscreen;
- the estimated total distance of toll roads that the vehicle operator plans to cross in the course of a designated time period in the postpay mode;
- company name/business name/name and surname of the vehicle operator;
- the name or business name, or the name and surname of the vehicle owner, if different from the vehicle operator;
- e-mail address of the vehicle operator.
The user is responsible for the accuracy of the reported data and the documents submitted.
In the absence of an emission class in the vehicle technical certificate or the vehicle registration certificate, information on the emission class may be supported by a valid CEMT certificate.
If a valid emission class is not clearly demonstrated for a vehicle registered in an EU Member State, it can be assigned according to the date of first registration of the vehicle as specified in the vehicle technical certificate or in the vehicle registration certificate. If this emission class assignment cannot be used, then the Euro II emission class is assigned to the vehicle in the electronic toll system.
If the emission class is not clearly demonstrated for a vehicle registered outside the EU, then the Euro II emission class will be assigned to the vehicle in the electronic toll system.
In a subsequent demonstration of Euro III and above, the vehicle will be registered in the appropriate category.
The system operator shall be entitled to acquire a scan of the vehicle technical certificate, the vehicle registration certificate and the CEMT Certificate submitted by the user when registering a vehicle in the electronic toll system.
Upon receipt of the electronic device, the user shall receive from the system operator a document containing the acquired data, which the user is obliged to check on the spot. If the user does not object to the registered data upon receipt of the document, he/she shall then be responsible for their accuracy. The vehicle operator is obliged to promptly ensure the correction of inaccurate data in the electronic toll system.
The system operator keeps the recorded data in electronic form for 5 years after the cancellation of the toll account to an electronic device.
If the system operator discovers any discrepancy between the registered data essential for setting the toll rate with the data specified in the vehicle technical certificate or in the vehicle registration certificate or in the CEMT, the system operator shall be entitled to change these incorrectly registered data within 48 hours after sending an e-mail notification of the non-compliance detected to the vehicle operator.
Along with the change of the registered data, the system operator shall re-establish the toll amount for all registered toll events of the vehicle whose registered data have been corrected. The difference discovered compared to the initially determined toll amount in the prepay mode shall be settled against the prepaid toll and in the postpay mode the difference shall be settled in an Invoice.
The vehicle operator is obliged to inform the system operator of any changes to the registered data within five days of the day when the change occurred. The user shall be subject to penalties under the Act if he/she uses toll Roads with incorrect data in the electronic equipment.
To determine the toll payment liability, the data recorded by the electronic toll system (e.g. toll events) are used. The user acknowledges the fact that on the basis of the data recorded by the electronic toll system, the user shall be obliged to pay a toll even if the toll event has not been recorded, but it is clear from the records in the electronic toll system that the vehicle has used a toll road in that toll section.
In the electronic toll system it is possible to pay a toll either
- in the prepay mode, or
- in the postpay mode.
The toll is paid in both modes only on behalf of the Czech Republic, regardless of the means of payment used. The payment mode is agreed before the vehicle is registered in the electronic toll system.
The condition for allowing toll payment in postpay mode is to meet the following conditions:
- Conclusion of a postpay terms agreement with deferred payment (with bank guarantee) or a postpay terms agreement with fuel card payment. Postpay terms agreements or their amendments can be concluded on behalf of the vehicle operator by its statutory body or by another person who will present to the system operator a written power of attorney with an officially verified signature of the person authorized to act on behalf of the vehicle operator. The form of the power of attorney can be picked up by the vehicle operator at a contact point or printed on the customer portal.
- For the purpose of concluding the postpay terms agreements, the vehicle operator shall be obliged to provide the system operator with the following data, in particular:
- the company name and the registered office if the vehicle operator is a legal person;
- name, surname, date of birth, address of residence, nationality, if the vehicle operator is a natural person;
- name and surname, date of birth, nationality and address of residence of an authorized representative;
- the identification number of the vehicle operator, if assigned, or a similar corresponding data in another country;
- the TAX ID number of the vehicle operator/VAT ID number, if assigned;
- registration data of the vehicle operator in the business register or a similar register, if registered in such register;
- the vehicle license plate number and the country where the vehicle is registered;
- the vehicle category pursuant to the applicable legislation
- the total vehicle weight, number of axles and vehicle emission class;
- an indication whether the vehicle is equipped with a device or a modification that could prevent the proper functioning of the electronic device.
- the estimated total distance of toll roads that the vehicle operator plans to cross in the course of a designated time period in the postpay mode;
- the vehicle operator's banking details;
- the vehicle operator's contact details, including the e-mail address.
- Acceptance of a fuel card for payment of toll, deposits and service fees according to the List of fees by its issuer in the case of a postpay terms agreement with the fuel card payment.
- Arrangement of a bank guarantee and handing over of the guarantee certificate to the system operator in case of a postpay terms agreement with deferred maturity. The bank guarantee must be issued for an amount requested by the system operator.
Until the time when the system operator has decided whether the vehicle operator meets the conditions specified above, the toll may only be paid in the prepay mode.
When you change your payment mode, you must return your original and pick up your new electronic device.
If a vehicle is registered by the vehicle operator in the electronic toll system and at the same time there is outstanding toll and/or other liabilities of the vehicle operator, the system operator may refuse to register the new vehicle of the vehicle operator or a proposal for amending the concluded postpay terms agreement.
If there is a change in the operator of a vehicle registered in the electronic toll system, the new vehicle operator, its authorised representative or, under the prepay mode also the driver, shall be obliged, before using the toll roads, to request the re-registration of the vehicle in the electronic toll system and provide the system operator with the new registration data.
The original vehicle operator shall be obliged to return the electronic device and pay all the liabilities towards the system operator.
All rights and obligations of vehicle operators, vehicle drivers and, where applicable, authorized persons relating to contracts and registration are governed by the relevant provisions of the system operator's general terms and conditions as well as the relevant provisions of the Act.
