Agreements on electronic toll payment terms in different modes

Postpay terms agreements

Postpay terms agreements or their amendments can be concluded on behalf of the vehicle operator by its statutory body or another person who will present to the system operator a written power of attorney with an officially verified signature of the person authorized to act on behalf of the vehicle operator. The form of the power of attorney can be picked up by the vehicle operator at a contact point or printed from the customer portal.

The vehicle operator shall be obliged to provide the system operator with the following data for the purpose of concluding the postpay terms agreements, in particular:

(a) the company name and the registered office if the vehicle operator is a legal person;

(b) name, surname, date of birth, address of residence, nationality, if the vehicle operator is a natural person; 

(c) name and surname, date of birth, nationality and residential address of an authorized representative;

(d) the identification number of the vehicle operator, if assigned, or a similar corresponding data in another country;

(e) the TAX ID number of the vehicle operator or the VAT ID number, if assigned;

(f) registration data of the vehicle operator in the business register or a similar register, if registered in such a register;

(g) the vehicle license plate number and the country where the vehicle is registered;

(h) the vehicle category pursuant to applicable legislation, particularly the decree;

(i) the total vehicle weight, number of axles and vehicle emission class;

(j) an indication whether the vehicle is equipped with a device or a modification that could prevent the proper functioning of the electronic device (on-board unit);

(k) the estimated total distance of toll roads that the vehicle operator plans to cross in the course of a designated time period in the postpay mode;

(l) the vehicle operator's banking details;

(m) the vehicle operator's contact details including e-mail address. 

 

Postpay terms agreements with deferred maturity

Each vehicle operator may enter into a postpay terms agreement with deferred maturity at a contact point or through the customer zone for any number of toll-liable vehicles it operates. In the event of closing a postpay terms agreement with deferred maturity at a contact point, the vehicle operator shall sign the postpay terms agreement with deferred maturity in paper form, either directly at the contact point or outside of the contact point with subsequent delivery to the system operator by post. When concluding the postpay terms agreement with deferred maturity outside of the contact point, the signature of the vehicle operator must be officially certified. In the event of closing the postpay terms agreement with deferred maturity through the customer zone, the vehicle operator shall sign the postpay terms agreement with deferred maturity in electronic form using the guaranteed electronic signature.

The condition for entry into force of the postpay terms agreement is the submission of the guarantee certificate confirming the bank guarantee, whose amount in Czech currency will be determined according to the following formula:

BG = ∑ (T * KM * (BP + 2 * DD + 3))
where:

  • "BG" means bank guarantee
  • "Σ" means the sum of partial guarantees of individual vehicles registered with the postpay terms agreement with deferred maturity;
  • "T" means the maximum toll rate for a given vehicle category;
  • "KM" means the estimated number of kilometres driven by a given vehicle per day on toll roads;
  • "BP" means the length of the billing period in days
  • "DD" means the period of maturity of the Invoice in days.

 

The amount of the bank guarantee calculated according to this formula must be at least CZK 2,500 for each vehicle specified in the postpay terms agreement. The maximum amount of the bank guarantee is not limited.

The system operator shall be entitled to assess the submitted bank guarantee within 30 days of its delivery and to decide on its acceptance or non-acceptance. It then informs the vehicle operator of its acceptance or non-acceptance and states the reason for not accepting it.

The postpay terms agreement comes into effect on the acceptance date of the warranty certificate confirming the bank guarantee. At the request of the system operator, the vehicle operator can pick up the electronic device (or multiple electronic devices) at a contact or distribution point, or the electronic device will be delivered by post.

 

Amendment to the postpay terms agreements with deferred Maturity

When amending the data on whose basis the minimum amount of the bank guarantee has been calculated or if the bank guarantee is insufficiently covered, the vehicle operator is obliged to provide a new bank guarantee or an amendment to the bank guarantee issued and accepted by the system operator. The new or the amended bank guarantee must take into account parameter changes in the calculation of the minimum amount of the bank guarantee. The system operator then informs the vehicle operator of its acceptance or non-acceptance and specifies the reason in case of non-acceptance.

The system operator is entitled to unilaterally increase the minimum amount of the bank guarantee, while the vehicle operator is obliged to provide additional security for the toll payment liability.

An amendment to the postpay terms agreement can be made by the vehicle operator or its authorized representative in person at a contact point, through the claim form or through the customer zone.

The system operator shall register any changes to the data in the electronic toll system without unreasonable delay and, in the event that the essential requirements of the postpay terms agreement change, the vehicle operator shall be obliged to conclude an amendment to the existing postpay terms agreement.

In the event of a change of data being reported at a contact point or through a claim form, the vehicle operator shall sign an amendment to the postpay terms agreement with deferred maturity in paper form, either directly at a contact point or outside of a contact point with subsequent delivery to the system operator by post. When signing the postpay terms agreement with deferred maturity outside of a contact point, the signature of the vehicle operator must be officially certified. In the event of a change of data being reported through the customer zone, the vehicle operator shall sign an amendment to the postpay terms agreement with deferred maturity in electronic form using a guaranteed electronic signature.

 

Postpay terms agreement with fuel card payment

Each vehicle operator may request at a contact point or at fuel card issuers specified by the system operator to enter into the postpay terms agreement with a fuel card payment for an arbitrary number of the vehicles that it operates. The vehicle operator shall be obliged to submit to the system operator all fuel cards that will be used to pay the toll, the deposit and other service fees according to the list of fees for authorisation by the fuel card issuer. This also applies in cases where an additional vehicle is registered under an already concluded postpay terms agreement with fuel card payment.

The postpay terms agreement with fuel card payment shall only take effect after confirmation of the authorisation by fuel card issuer.
If the fuel card expires or the fuel card issuer blocks the fuel card, the relevant electronic device (i.e. any electronic device that records toll events paid by this fuel card) will be blocked by the system operator.


Amendment to the postpay terms agreement with fuel card payment

If the vehicle operator requests a change of the fuel card (a requirement to use another fuel card of the same publisher), it shall be obliged to submit a new fuel card to the system operator for authorisation or request a change of the issuer of this fuel card.

If the vehicle operator requires a change to the fuel card issuer, he/she is obliged to return all originally used electronic devices, terminate the original postpay terms agreement and enter into a new postpay terms agreement with a fuel card payment.

An amendment to the postpay terms agreement with fuel card payment can be made by the vehicle operator or his/her authorized representative in person at a contact point, through the claim form or through the issuer of this fuel card.

The system operator shall register any changes to the data in the electronic toll system without unreasonable delay and, in the event that the essential requirements of the postpay terms agreement with a fuel card payment change, the vehicle operator shall be obliged to conclude an amendment to the existing postpay terms agreement with a fuel card payment.
